

WHAT IS MEDIATION?
Mediation is a dispute resolution process designed to assist parties to a legal conflict resolve their dispute without a judge, jury, or arbitrator deciding the case for them.
In mediation, a neutral third party (the mediator) meets with the opposing sides to help them find a mutually satisfactory solution.
Unlike a judge in a courtroom or an arbitrator conducting a binding arbitration, the mediator has no power to impose a solution. No formal rules of evidence or procedure control mediation; the settlement discussions are confidential and are not generally admissible in court; and the parties have the option of a trial or arbitration if they choose not to settle the case.

- Real Estate Disputes: including residential and commercial purchase and sale agreements, Form 17 disclosure issues, earnest money disputes, loan defaults and workouts, valuation issues, partnership disputes, real estate broker liability, mortgage agent liability, appraiser liability, and misrepresentation and fraud claims.
- Residential and Commercial Construction Disputes: including owner-contractor disputes, construction defect claims, and payment/lien issues.
- Commercial Disputes: including corporate and partnership governance and control issues, commercial and financial contract disputes, valuation disputes, buy-sell issues, and secured and unsecured creditor-debtor issues.
- Insurance Coverage: including property insurance cases, coverage issues (first party claims), and third party claims.
- Motor Vehicle Personal Injury and other Tort Disputes: including motor vehicle and truck accident cases, multi-party vehicle incidents, nursing home negligence, premises liability, professional negligence, and general negligence claims.
- Trust & Estate and Probate Disputes: including family asset allocation, will contests, TEDRA, and fiduciary issues.
